1. Project Scope & Acceptance

All projects are delivered based on the scope of work approved prior to development. Upon delivery, the client is responsible for reviewing and approving the system.

Any requests outside the original agreed scope will be treated as a new service request and quoted separately.


2. 1-Year Limited Warranty

It is our company policy to provide a one (1) year limited warranty on custom software development projects, starting from the official delivery date.

This warranty covers:

  • Bugs directly related to the original source code developed by Merhouse
  • Functional errors preventing the system from operating as agreed in the approved scope

This warranty does NOT cover:

  • Third-party services (APIs, plugins, payment gateways, SDKs, hosting providers, etc.)
  • Platform or framework updates (WordPress, Adalo, PHP versions, server environments, browsers, etc.)
  • Hosting configuration changes
  • Security vulnerabilities caused by lack of updates
  • Modifications made by the client or third parties
  • Feature upgrades, redesigns, enhancements, or new functionality

3. Post-Warranty Support

After the 1-year warranty period expires, all services are billed as new service requests.

  • System diagnosis and review (up to 2 hours): $150 CAD
  • Additional time beyond 2 hours: billed at hourly rate
  • New development, structural modifications, or integrations: quoted separately

No additional work will be performed without written client approval.


4. Maintenance Responsibility

The client acknowledges that websites and applications require ongoing maintenance to remain secure and functional.

Merhouse is not responsible for system failures caused by:

  • Outdated software
  • Expired licenses
  • Hosting changes
  • Third-party service interruptions
  • Security breaches outside of active maintenance agreements

We strongly recommend maintaining an active support plan to prevent disruptions.


5. Payment Terms

All maintenance, troubleshooting, and additional development services must be paid in advance unless otherwise agreed in writing.

Failure to complete payment may result in suspension of ongoing services.


6. Limitation of Liability

Merhouse shall not be liable for indirect, incidental, consequential, or financial damages resulting from:

  • Software downtime
  • Third-party service failures
  • Hosting interruptions
  • Loss of data not backed up by the client
  • Business interruption

The client is responsible for maintaining regular backups unless covered under an active maintenance agreement.
